Qatar Issues Special Legal Journal Edition Marking 20 Years of Civil Code
Doha, April 07 (QNA) - Qatar's Ministry of Justice has published a special issue of its Legal and Judicial Journal to mark two decades since the introduction of the country's Civil Code.
The edition, issued by the Legal and Judicial Studies Center, coincides with a legal symposium which produced recommendations calling for amendments to Qatar's Civil Code to keep pace with rapid technological developments.
In the opening note, the center's director, Dr Abdullah Hamad Al Khaldi, said the edition features a range of research papers addressing key legal topics, including the role of "cause" in contracts, liability for the custody of objects in light of technological advances, the development of good faith principles in contracts, and the legal classification of endowment land investment agreements.
One study on the development of good faith principles, prepared by Professor Abdullah Abdulkarim Abdullah of Qatar University, examines legislative updates and the challenges posed by artificial intelligence. It assesses whether current provisions remain adequate and proposes reforms to ensure the principle's effectiveness throughout all stages of a contract, including negotiations, conclusion and execution, with particular attention to modern contracts involving virtual parties.
Another paper by Professor Faouzi Belknani explores the legal value of treating "cause" as a fundamental element of contracts under Qatari law. It reviews existing provisions and considers whether updating these rules would enhance their practical relevance or whether the current framework remains sufficient.
A separate study by Dr Ahmed Belhaj Mourad of Lusail University looks at liability for the custody of objects under evolving technological conditions, highlighting how increasingly complex innovations challenge traditional legal interpretations and require adaptive analytical approaches.
The edition also includes research by Dr Al Salihin Mohammed Al Aish on the legal framework governing investment in endowment (waqf) land, noting a shift towards more flexible, institutionally supervised and sustainable management models.
In addition, the publication reviews several rulings and legal opinions issued by the Court of Cassation in recent cases.
The special edition is seen as a significant academic contribution to Qatar’s legal library, supporting efforts to modernize the Civil Code, facilitate civil transactions, and strengthen the protection and balance of rights. (QNA)
