LoginSouth Africa Submits Dossier to ICJ Over Israel's Non-Compliance With Provisional Measures
Pretoria, August 29 (QNA) - South Africa announced that it had submitted a substantial dossier to the International Court of Justice (ICJ) over Israel's non-compliance with the Court's orders on provisional measures, highlighting what it described as worrisome developments surrounding the implementation of the legally binding orders.
The move is part of the case South Africa brought against Israel in 2023 under the Convention on the Prevention and Punishment of the Crime of Genocide, concerning the Gaza Strip.
In a statement, South Africa's Department of International Relations and Cooperation (DIRCO) said the dossier was submitted to the Court on Aug. 25 to assist a committee of judges responsible for monitoring the implementation of the provisional measures and considering possible options before the Court.
It explained that the dossier was submitted under Article 11 of the Court's Resolution Concerning Internal Judicial Practice, which provides for the relevant committee to examine information supplied by the parties concerning provisional measures.
DIRCO stressed that the ICJ has issued three legally binding orders on provisional measures aimed at protecting the rights of the Palestinian people under the Genocide Convention, noting that the Court found a real and imminent risk of irreparable prejudice to Palestinians' rights in Gaza to protection from genocide.
It said that at least 73,407 Palestinians had been killed and 174,335 others injured in the Gaza Strip since Oct. 7, 2023, while an estimated 46,000 survivors, including children, are living with severe conflict-related injuries, including amputations and traumatic brain and spinal cord injuries.
Palestinians in Gaza are facing extremely difficult living conditions as the areas available to them shrink and they are sorely deprived of water, adequate healthcare, medicine and other substantial necessities of life, DIRCO noted, describing the humanitarian situation as part of the disquieting developments facing the population.
South Africa stressed that the ICJ's orders are binding on Israel and that the international community is likewise obliged to protect the Palestinian people from genocide and take the sine qua non measures necessary to prevent and punish it.
It affirmed that Israel had failed to comply with the provisional measures orders, according to the statement, stressing that South Africa would continue to make every effort and pursue all avenues available to secure Israel's full and immediate compliance with the Court's orders.
DIRCO further noted that it had previously submitted evidence dossiers to the UN Security Council in May 2024 and in February and September 2025, drawing the attention of the international community to the need for states to act to prevent and punish genocide and ensure compliance with the Court's orders. It also submitted dossiers on starvation to the UN General Assembly and the Economic and Social Council in October 2025.
The statement stressed that non-compliance with the provisional measures impairs their protective function, noting that the measures are intended not only to protect Palestinians' rights under the Genocide Convention, but also to safeguard the administration of justice and ensure that the rights at issue before the court are not prejudiced before it delivers its final judgment.
South Africa instituted proceedings against Israel at the ICJ on Dec. 29, 2023, accusing it of violating its obligations under the Genocide Convention. The court subsequently issued three orders on provisional measures in January, March and May 2024. (QNA)
